These Terms and Conditions (“Agreement”) govern the use of hosting services (“Services”) provided by 08-Servers, operating cloud-based servers located in London, UK. By using our Services, you agree to be bound by this Agreement.

1. Service Overview

We provide web hosting services on secure cloud servers located in London, UK. Our services include server hosting, software management, firewall protection, optional backups, and customer support.

Our servers maintain a 99.99% uptime, supported by robust infrastructure and monitoring. However, 08-Servers shall not be held liable for any downtime caused by force majeure, hardware failure, war, riots, natural disasters or events beyond our control.

2. Acceptable Use Policy

  • No Marketing Emails: Sending unsolicited bulk emails (spam), including marketing or promotional emails, is strictly prohibited. Accounts engaged in such activities will be suspended or terminated without notice.
  • No Spamming: We do not tolerate spam of any kind. Any account found spamming, intentionally or due to negligence (e.g., compromised email account), will be suspended immediately.

3. Server Maintenance & Liability

  • We maintain and regularly update our server infrastructure, including security patches and software upgrades.
  • While we make every effort to provide continuous uptime and protection, we cannot be held liable for any server outage, downtime, data loss, or technical issues outside of our direct control.

4. Backups

  • We offer weekly and monthly backups as an optional paid service.
  • Clients are solely responsible for maintaining their own up-to-date backups unless subscribed to our backup plans.
  • Backup services do not cover emails.

5. Email Usage Policy

  • POP3 is required for email use. Clients must download and store their emails locally.
  • IMAP usage is discouraged and unsupported. We do not accept responsibility for any emails lost, deleted, or corrupted on the server.
  • If an email account is compromised (e.g., due to local device infection), we will suspend the account immediately to protect both our infrastructure and the client’s reputation.
    This suspension helps:
    • Prevent further spam being sent from the compromised account.
    • Protect the client’s domain from being blacklisted.
    • Avoid distribution of viruses or fraud using the client’s company name.
      The client must clean their local system before we reset and reactivate the email account with a new password.

6. Security Measures

  • We provide free SSL certificates for all hosted domains.
  • Our servers are protected by a strict firewall to enhance client security.
  • SpamAssassin is installed to reduce incoming spam emails. This is the extent of our spam filtering service.
  • It is the client’s responsibility to ensure no viruses, malware, or malicious files are uploaded to our servers.

7. Suspension and Termination

We reserve the right to suspend or terminate any account that:

  • Violates our Acceptable Use Policy.
  • Causes harm to the server environment or other clients.
  • Fails to resolve security or abuse issues in a timely manner.

8. Limitation of Liability

To the maximum extent permitted by law:

  • 08-Servers, its owners, employees, affiliates, or partners shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to loss of profits, business interruption, loss of data, reputational damage, or cost of procurement of substitute goods or services.
  • We make no warranties or guarantees regarding the uptime, availability, speed, or security of our services. All services are provided “as is” and “as available.”
  • We do not guarantee protection against all cyber threats, intrusions, viruses, or exploits. Clients are responsible for their own cybersecurity hygiene.
  • We are not liable for service interruptions caused by force majeure events, hardware failure, power outages, natural disasters, or third-party service disruptions beyond our control.
  • In no event shall 08-Servers’ total liability to the client for all damages, losses, and causes of action exceed the total amount paid by the client to 08-Servers in the previous three (3) months.
  • This limitation shall apply even if 08-Servers has been advised of the possibility of such damages or if any remedy fails of its essential purpose.

9. Client Responsibilities

  • Clients are responsible for their content, data, and activities hosted on our servers.
  • Clients must take necessary precautions to secure their devices and passwords.
  • Clients are required to comply with applicable laws, including but not limited to GDPR and anti-spam regulations.

10. Amendments

We reserve the right to update these Terms and Conditions at any time. Changes will be posted on our website and will take effect immediately.
